Lawful bases and data protection rights
Under UK data protection law, we must have a “lawful basis” for collecting and using your personal information. There is a list of possible lawful bases in the UK GDPR. You can find out more about lawful bases on the ICO’s website.
Which lawful basis we rely on may affect your data protection rights which are set out in brief below. You can find out more about your data protection rights and the exemptions which may apply on the ICO’s website:
- Your right of access — You have the right to ask us for copies of your personal information. You can request other information such as details about where we get personal information from and who we share personal information with. There are some exemptions which means you may not receive all the information you ask for.
- Your right to rectification — You have the right to ask us to correct or delete personal information you think is inaccurate or incomplete.
- Your right to erasure — You have the right to ask us to delete your personal information.
- Your right to restriction of processing — You have the right to ask us to limit how we can use your personal information.
- Your right to object to processing — You have the right to object to the processing of your personal data.
- Your right to data portability — You have the right to ask that we transfer the personal information you gave us to another organisation, or to you.
- Your right to withdraw consent — When we use consent as our lawful basis you have the right to withdraw your consent at any time.
If you make a request, we must respond to you without undue delay and in any event within one month.
To make a data protection rights request, please contact us using the contact details at the top of this privacy notice.
Our lawful bases for the collection and use of your data
Our lawful bases for collecting or using personal information to provide services and goods are:
- Legitimate interests — we’re collecting or using your information because it benefits you, our organisation or someone else, without causing an undue risk of harm to anyone. All of your data protection rights may apply, except the right to portability. We use website user information, including cookie tracking, to operate Verifyndr's core function: helping users discover clothing across multiple online retailers and referring them to the correct retailer when they choose to purchase. This tracking allows us to attribute purchases to Verifyndr so that we can earn a commission from our retail partners, which is how the service is funded and kept free for users. The information collected is limited to browsing and click-through behaviour on our site — we do not collect financial, payment, or highly sensitive personal information as part of this process. The impact on individuals is minimal: the tracking does not affect their ability to use the site, does not result in unsolicited contact, and is not used to build detailed personal profiles beyond what is necessary for affiliate attribution. Given the limited scope and low risk of this processing, and the fact that it is essential to sustaining a free discovery service, we consider our interest in this processing to outweigh any minimal impact on the individual.
Our lawful bases for collecting or using personal information for legal requirements are:
- Legal obligation — we have to collect or use your information so we can comply with the law. All of your data protection rights may apply, except the right to erasure, the right to object and the right to data portability.
Our lawful bases for collecting or using personal information for dealing with queries, complaints or claims are:
- Legitimate interests — We use names, contact details, and correspondence submitted by users to respond to queries, complaints, or claims about the Verifyndr service. This processing is necessary so that we can properly address issues raised by users, provide support, and improve the service based on feedback. Without collecting this information, we would be unable to respond to or resolve user concerns. The information is only used for the purpose of handling the specific query or complaint, is not shared with third parties beyond what is necessary to resolve the issue, and is retained only for as long as needed to deal with the matter. As this processing directly benefits the individual raising the query and carries minimal risk of harm, we consider our interest in handling these communications to outweigh any impact on the individual's privacy.
Where we get personal information from
- Directly from you
- Third parties — Awin Limited (affiliate marketing network): We use Awin, an affiliate marketing network, to track when users click through from Verifyndr to a retailer's website. When a user clicks an outbound link to a partner retailer, an affiliate tracking cookie is set via Awin, which allows Awin and the retailer to attribute any resulting purchase back to Verifyndr. This enables Verifyndr to earn a commission on referred sales. Awin acts as an independent data controller for the information processed through this tracking mechanism. No personal data such as names, addresses, or payment details is shared with us by Awin or the retailer — we only receive aggregated performance and commission data.
How long we keep information
We keep correspondence relating to queries, complaints, or claims for 12 months after the matter has been resolved, after which it is securely deleted.
We do not directly store website user or cookie tracking data ourselves. This information is processed via our affiliate network (Awin) and retained only for the duration of their tracking cookie lifespan, which is typically 30 days from the date of the click, in line with Awin's own retention practices. We do not build long-term profiles from this data.
Who we share information with
Data processors
Lovable Labs Incorporated (website hosting and development platform provider, USA) hosts and runs the Verifyndr website on our behalf, including storing website data and enabling core site functionality. As our hosting provider, they process website user information (such as browsing activity on the site) purely to deliver the technical infrastructure that keeps Verifyndr running — they do not use this data for their own independent purposes.
Others we share personal information with
- Relevant regulatory authorities
- Organisations we're legally obliged to share personal information with
Sharing information outside the UK
Where necessary, our data processors may share personal information outside of the UK. When doing so, they comply with the UK GDPR, making sure appropriate safeguards are in place.
- Lovable Labs Incorporated — Website hosting and software development platform provider, United States. Transfer complies via an Addendum to the EU Standard Contractual Clauses (SCCs).
- Google Ireland Limited / Google LLC — Email service provider, United States. Transfer complies via an Addendum to the EU Standard Contractual Clauses (SCCs).
